Terms and Conditions
These Terms and Conditions set out the rules for using the JollyHeap online shop available at shop.jollyheap.com and www.jollyheap.com (the “Shop”) and for concluding sales contracts through it. The Shop is operated by “JollyHeap” Svitlana Sapunova, with its registered office at Aleja Led 4, 55-020 Rzeplin, Poland, NIP 8992772832 (the “Seller”).
By placing an order, the Customer confirms that they have read and accept these Terms and Conditions.
1. Definitions
Seller – “JollyHeap” Svitlana Sapunova, NIP 8992772832, Aleja Led 4, 55-020 Rzeplin, Poland.
Shop – the online shop operated by the Seller at shop.jollyheap.com and www.jollyheap.com.
Customer – any natural person, legal person or organisational unit that places an order in the Shop.
Consumer – a Customer who is a natural person making a purchase for purposes not directly related to their business or professional activity.
Business Customer – a Customer who is not a Consumer, including distributors and resellers.
Goods – the products offered in the Shop, in particular soft magnetic building blocks.
Order – the Customer’s declaration of intent aimed at concluding a Sales Contract.
Sales Contract – the contract for the sale of Goods concluded between the Seller and the Customer through the Shop.

3. General provisions
3.1 Through the Shop the Seller offers Goods for sale, in particular soft magnetic building blocks for soft play, therapy and learning, and provides electronic services consisting in enabling Customers to place Orders.
3.2 The Shop sells to both Consumers and Business Customers (including distributors and resellers).
3.3 To use the Shop, the Customer needs a device with internet access, a current web browser and an active e-mail account.
3.4 The Customer is obliged to use the Shop in a manner consistent with the law and good practice, and not to provide unlawful content.
4. Goods and prices
4.1 Information about the Goods presented in the Shop, in particular their descriptions, specifications and prices, constitutes an invitation to conclude a contract within the meaning of the applicable law, and not an offer.
4.2 The prices of the Goods are given in the currency indicated in the Shop and include applicable taxes (VAT). Prices do not include delivery costs, which are shown separately during the ordering process.
4.3 The price binding for the parties is the price shown in the Shop at the moment the Customer places the Order.
5. Placing an order and conclusion of the contract
5.1 The Customer places an Order by adding the selected Goods to the basket and confirming the Order using the relevant button, after providing the data required for delivery and invoicing.
5.2 Placing an Order with an obligation to pay is confirmed by the Seller by sending an e-mail to the address provided by the Customer. The Sales Contract is concluded upon the Customer’s receipt of this confirmation.
5.3 The Seller reserves the right not to process an Order in justified cases, in particular if the Customer’s data is incomplete or incorrect, or if the Goods are unavailable; in such a case the Seller informs the Customer without undue delay and returns any payment received.
6. Payment
6.1 The Seller makes available the payment methods presented in the Shop during the ordering process, including online payment by payment card.
6.2 The Customer is obliged to make payment within the time specified during the ordering process. Unless agreed otherwise, the Goods are dispatched after the payment has been credited.
6.3 A VAT invoice or receipt is issued for each sale in accordance with applicable regulations.
7. Delivery
7.1 The Goods are delivered to the address indicated by the Customer in the Order. The Shop delivers within the European Union and to a number of countries worldwide.
7.2 Delivery times, costs and available delivery methods are described on the Delivery time and costs page, which forms an integral part of these Terms and Conditions.
8. Consumer’s right of withdrawal
8.1 A Consumer who has concluded a distance contract may withdraw from it without giving any reason within 14 days from the date of receipt of the Goods, in accordance with applicable consumer protection law.
8.2 The detailed procedure for withdrawal, the relevant forms and the rules for returning the Goods and refunding payments are described on the Returns and complaints page.
8.3 The right of withdrawal referred to above does not apply to Business Customers.
9. Complaints and warranty
9.1 The Seller is obliged to deliver Goods free from defects. The Seller is liable to the Customer for the conformity of the Goods with the Sales Contract on the terms provided for by law.
9.2 Complaints may be submitted by e-mail to info@jollyheap.com or by post to the Seller’s address. The complaint procedure and the complaint form are described on the Returns and complaints page.
9.3 The Seller responds to a complaint without undue delay, within the time limit provided for by applicable law.
10. Personal data protection
Personal data of Customers is processed by the Seller as the data controller in accordance with the GDPR (RODO) and the rules described in the Privacy Policy, which forms an integral part of these Terms and Conditions.
11. Intellectual property
All content of the Shop, in particular texts, graphics, logos, photographs and product descriptions, is protected by law and constitutes the property of the Seller or is used by the Seller under appropriate rights. Their use without the Seller’s prior written consent is prohibited.
12. Out-of-court dispute resolution
A Consumer has the option of using out-of-court methods of dealing with complaints and pursuing claims. In particular, the Consumer may use the EU online dispute resolution (ODR) platform available at ec.europa.eu/consumers/odr.
13. Final provisions
13.1 These Terms and Conditions are governed by Polish law. This choice of law does not deprive a Consumer of the protection afforded to them by the mandatory provisions of the law of their country of habitual residence.
13.2 The Seller may amend these Terms and Conditions for important reasons, in particular changes in the law or in the scope of services provided. Orders placed before the entry into force of the changes are processed under the existing rules.
13.3 In matters not regulated by these Terms and Conditions, the applicable provisions of law shall apply.
